Privacy Policy

This Privacy Policy explains how The FOSS Method, operated by Foss Consulting LLC ("we," "us," or "our"), collects, uses, and protects information when you visit mattfoss.com (the "Site") or use the tools we offer on it, including the free book chapter request and The Score leadership assessment. By using the Site, you agree to the practices described here.
Information We Collect
We collect information in two ways: what you give us directly, and what is gathered automatically as you use the Site.
Information You Provide
- Contact details. Your name and email address when you fill out a form, request the free book chapter, or sign up to hear from us.
- Assessment responses. The answers and information you submit when you take The Score, our leadership assessment.
- Anything else you send us. Messages, questions, or details you include when you contact us by email or through a form.
Information Collected Automatically
- Basic technical and usage data. Standard information such as your browser type, device type, general location, the pages you view, and how you arrived at the Site. We keep this minimal and use privacy-first tools where we can.
- Identifiers. Limited technical identifiers, such as an IP address, that come with normal web requests and help the Site function and stay secure.
Sensitive Information
We do not ask for sensitive personal information such as your Social Security number, financial account numbers, health information, or government-issued ID, and we ask that you not send it to us. The Score is a leadership self-assessment and is not designed to collect special categories of personal data.
How and Why We Use Your Information
We use the information we collect to:
- Deliver what you asked for, such as the book chapter or your results from The Score.
- Respond to your questions and follow up with you.
- Send you emails about our coaching, content, and offers, when you have opted in to hear from us.
- Operate, maintain, and improve the Site and our tools.
- Keep the Site secure and protect against fraud or abuse.
- Meet our legal and compliance obligations.
If you are in a region that requires a legal basis to process your information, we rely on your consent (for example, marketing emails), the performance of what you asked us to do (for example, sending the book chapter or your assessment results), our legitimate interest in running and improving our business, and compliance with our legal obligations.
Third Parties and Service Providers
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do share it with trusted service providers who help us run our business. They may only use your information to perform services for us. These include:
- GoHighLevel. Our customer relationship management (CRM) platform, where we store contact details and assessment responses and manage our communications with you.
- Netlify. Our website hosting and form provider, which processes the information you submit through forms on the Site.
- Email delivery. We send email from send.mattfoss.com using email service providers that deliver our messages and report basic delivery and engagement data.
- Analytics. A privacy-first analytics tool that gives us aggregate, minimal usage data without invasive tracking.
We may also disclose information if required by law, to enforce our terms, or to protect the rights, safety, and property of our business, our clients, or others. If our business is ever involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction, and we will let you know if it becomes subject to a different privacy policy.
Cookies and Analytics
We keep cookies and tracking to a minimum. Our analytics is privacy-first, which means it focuses on aggregate trends rather than building a profile of you, and it avoids invasive cross-site tracking. Some basic cookies may be used to keep the Site working properly. You can set your browser to refuse or delete cookies, though some parts of the Site may not work as well if you do. We also honor browser-based privacy signals, such as Global Privacy Control (GPC), where the law requires us to.
Email Marketing and How to Unsubscribe
If you opt in, we may send you emails about our content, coaching, and offers. Every marketing email includes a clear way to unsubscribe and our physical mailing address, and we honor unsubscribe requests promptly, in line with the CAN-SPAM Act. You can opt out at any time by clicking the unsubscribe link in any email or by emailing us at legal@mattfoss.com. Even after you unsubscribe from marketing, we may still send you transactional or service messages you have requested, such as a reply to a question or the file you asked for.
Data Retention
We keep your information for as long as we need it to provide what you asked for, run our business, and meet our legal obligations. When we no longer need it, we take reasonable steps to delete it or remove anything that identifies you. If you ask us to delete your information, we will do so unless we are required to keep it.
Your Choices and Rights
Depending on where you live, you may have rights over your personal information. In most cases you can:
- Access the information we hold about you, and ask to know how we have collected, used, and shared it.
- Correct information that is wrong or out of date.
- Delete your information, subject to any records we are required to keep.
- Opt out of marketing emails, and of any "sale" or "sharing" of personal information, at any time.
- A copy of the information you gave us in a portable format, where the law provides for it.
You also have the right not to be treated differently for exercising these rights. To make any of these requests, email us at legal@mattfoss.com. We may need to verify your identity before we act on a request, and we will respond within the time the applicable law requires.
Your U.S. State Privacy Rights
Several U.S. states have comprehensive privacy laws that give their residents specific rights. This section explains how those rights apply to us. Because our practices are the same for everyone, we extend the core rights below to all of our U.S. users, regardless of where you live.
All eligible state residents
Depending on your state (which currently includes California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and a growing list of others), you may have the right to: (1) confirm whether we process your personal information and access it; (2) correct inaccurate information; (3) delete information we hold about you; (4) obtain a portable copy of information you provided; and (5) opt out of the "sale" of personal information, "sharing" or processing for targeted advertising, and certain profiling. We do not sell your personal information, we do not share it for cross-context behavioral or targeted advertising, and we do not use it for profiling that produces legal or similarly significant effects. We also honor the Global Privacy Control (GPC) signal where the law requires it.
How to exercise your rights. Email legal@mattfoss.com with your request. You may use an authorized agent to submit a request on your behalf where the law allows, and we may ask the agent for proof of authorization and ask you to verify your own identity. We will not discriminate or retaliate against you for exercising any of these rights.
Right to appeal. If we decline your request, you may appeal by replying to our decision or emailing legal@mattfoss.com with the word "Appeal." We will respond with our decision and, in the states that require it, information on how to contact your state Attorney General if you disagree.
Additional information for California residents
Under the California Consumer Privacy Act, as amended by the CPRA, California residents have the rights described above, including the rights to know, access, correct, delete, and to opt out of the sale or sharing of personal information. In the past 12 months we have collected the following categories of personal information: identifiers (such as name, email address, and IP address), internet or network activity (such as pages viewed), and the information you voluntarily submit through our forms and The Score assessment. We collect this information for the business purposes described in "How and Why We Use Your Information," and we disclose it only to the service providers listed in this policy so they can perform services for us. We do not sell or share the personal information of any consumer, and we do not knowingly sell or share the personal information of anyone under 16. We do not collect the categories of "sensitive personal information" defined by California law, and therefore do not use or disclose it for purposes that would trigger a right to limit its use. California's "Shine the Light" law also lets California residents ask about personal information disclosed to third parties for their own direct marketing; we do not make such disclosures.
Security
We take reasonable steps to protect your information and rely on established service providers to help us do so. No method of sending or storing information over the internet is completely secure, so we cannot promise absolute security. If you have a security concern, please contact us at legal@mattfoss.com.
Children's Privacy
The Site is meant for business leaders and is not directed to anyone under 18. We do not knowingly collect personal information from children under 18. If you believe a child has given us their information, contact us at legal@mattfoss.com and we will delete it.
Links to Other Sites
The Site may link to websites we do not own or control. We are not responsible for the privacy practices or content of those sites. We encourage you to read the privacy policy of any site you visit.
International Visitors
We operate from the United States, and your information is processed and stored here. If you visit from outside the United States, you understand that your information will be transferred to and handled in the United States, where privacy laws may differ from those in your country.
Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will change the effective date at the top of this page. If the changes are significant, we will take reasonable steps to let you know. Your continued use of the Site after an update means you accept the revised policy.
